Acceptance of terms. By accessing or using the BookedWell website or services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use our services.

2. Services

Services. BookedWell provides AI receptionist and automation services that help local businesses answer calls, capture leads, and book appointments. Specific service features, pricing, and terms may be described in separate order forms or service agreements, which are incorporated into these Terms by reference.

3. Customer Responsibilities

Customer responsibilities. You are responsible for providing accurate and up-to-date information about your business, services, pricing, and scheduling rules; ensuring that your use of our services complies with all applicable laws and regulations (including telemarketing, privacy, and data protection rules); and promptly reviewing and responding to escalations or messages forwarded to your team.

4. SMS Communications

SMS Communications. By providing your phone number through our website forms or direct interaction with our services, you consent to receive SMS messages from BookedWell related to your inquiry, account setup, services, and appointment updates. Message frequency may vary. Message and data rates may apply. You can opt out at any time by replying STOP or request assistance by replying HELP. Consent to receive SMS messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

5. Messaging Compliance

Messaging compliance. When we send SMS or other messages on your behalf, you agree to only target contacts who have given appropriate consent; honor opt-out requests (such as STOP) promptly; and use content that is truthful, non-deceptive, and compliant with applicable carrier and regulatory guidelines. We may suspend or modify messaging campaigns that appear non-compliant or abusive.

6. Fees and Billing

Fees and billing. Unless otherwise stated in an order form, services are billed in advance on a recurring basis. Fees are non-refundable except where required by law or explicitly stated in writing. We may suspend or terminate services for unpaid invoices after providing reasonable notice.

7. Intellectual Property

Intellectual property. We retain all rights, title, and interest in and to our software, AI models, website, and related intellectual property. You retain ownership of your data and content that you provide to us. Granting us a limited license to use that content is necessary for us to deliver the services.

8. Disclaimer and Limitation of Liability

Disclaimer and limitation of liability. Our services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, and our liability in connection with the services is limited to the amounts you have paid to us for the services giving rise to the claim during the preceding twelve (12) months.

9. Changes to These Terms

Changes to these Terms. We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the services after changes become effective constitutes acceptance of the revised Terms.
